Анотація

У статті розглядається можливість вирішення спорів у місцевих громадах під час воєнного вторгнення, мирним шляхом за допомогою посередника (медіатора) в умовах зростання соціальної напруги у суспільстві, що є дуже потрібним для формування та посилення зав’язків між членами громади, для зміцнення довіри місцевої громади до обраних нею органів місцевого самоврядування. Розглядаються види і причини конфліктів у громадах та переваги швидкого врегулювання їх за участі всіх учасників спору та зацікавлених осіб за допомогою добровільної позасудової медіації.

INSTITUTE OF MEDIATION IN UKRAINE AS ONE OF THE ALTERNATIVE MECHANISMS OF PEACEFUL CONFLICT SETTLEMENT IN COMMUNITIES: PROBLEMS AND PROSPECTS OF DEVELOPMENT IN THE PERIOD OF MILITARY CONFLICT

English abstract

The war that came to the land of Ukraine, anxiety for soldiers, children and relatives who remained in the temporarily occupied territories, led to a sharp increase in the number of conflicts (disputes) in communities, overloading of courts and an increase in the terms of consideration of cases in courts. The article considers the possibility of resolving disputes in territorial communities by peaceful means with the help of a mediator (mediator) in the conditions of increasing social tension in society during a military invasion. The types and causes of conflicts in communities and the advantages of their quick settlement with the participation of all participants in the dispute and interested persons with the help of a voluntary out-of-court procedure – mediation are considered. The Institute of Mediation in Ukraine is at the stage of formation. In a period of war and growing social tension, the ability to resolve conflicts that highlight the diversity of views in local communities through peaceful means acquires great importance, and specialist mediators who have the skills to prevent or end disputes through negotiations will be extremely necessary in most local self-government bodies, should to work in state institutions, in the places of residence of forcibly resettled residents of our country and in host communities, schools, universities, among the military. To popularize mediation, it is necessary to conduct a wide information campaign in the media space of Ukraine, to study and adapt to the needs of Ukrainians the best foreign experience of other countries in the field of mediation, to train relevant specialists and prepare teams that will possess not only professional knowledge, but also psychological skills for conflict resolution, will adhere to the principles business ethics.
