Abstract

У статті досліджено інститут шлюбного договору, з’ясовано основні переваги та недоліки досліджуваного явища. Доведено, що перевагами є: встановлення, з ким із батьків проживатиме дитина, а також визначення чіткого розміру аліментів; запобігання можливим конфліктам і уникнення затяжних судових розглядів; на відміну від деяких європейських країн, шлюбний договір в Україні не може регулювати такі питання, як обмеження часу, проведеного з друзями, або питання, пов’язані з народженням дітей. Він також не може поставити одного з подружжя в надзвичайно невигідне становище, як це іноді трапляється в законодавстві деяких іноземних держав. Щодо недоліків шлюбного договору, то варто вказати на негативне сприйняття, колізію з Конституцією; складність укладання.

English abstract

The article examines the institution of the marriage contract, finds out the main advantages and disadvantages of the studied phenomenon. In particular, it has been proven that the advantages should include: establishing which parent the child will live with, as well as determining a clear amount of alimony; prevention of possible conflicts and avoidance of protracted legal proceedings; unlike some European countries, the marriage contract in Ukraine cannot regulate such issues as limiting the time spent with friends or issues related to the birth of children. Nor can it place one of the spouses at an extreme disadvantage, as sometimes happens in the legislation of some foreign countries. Regarding the shortcomings of the marriage contract, it is worth pointing out: negative perception; conflict with the Constitution; complexity of laying.
