Анотація

У статті розглянуто аспекти фінансового моніторингу як складової національної економічної та фінансової безпеки. Значну увагу було приділено сучасним тенденціям, які спостерігаються у сфері діджиталізації та інформатизації економіки, та визначено взаємозв’язок інформаційного середовища підприємства із діяльністю суб’єктів фінансового моніторингу. У статті зазначено, що швидкі темпи зростання масивів інформації сприяють «тінізації» фінансових операцій та перешкоджають оперативному відслідковуванню діяльності, що може бути пов’язана і відмиванням коштів та фінансуванням тероризму. Наведено перелік критеріїв оперативного та стратегічного аналізу для фінансового моніторингу операцій, які було розширено в умовах воєнного стану. Розглянуто принципи ризик-орієнтованого підходу, що використовується при виявленні підозрілих фінансових операцій, які можуть фінансувати терористичну діяльність.

FINANCIAL MONITORING OF BUSINESS ENTITIES UNDER THE MARTIAL LAW CONDITIONS

English abstract

The article examines aspects of financial monitoring as a component of national economic and financial security. Considerable attention was paid to modern trends observed in the field of digitalization and informatization of the economy, and the relationship between the information environment of the enterprise and the activities of financial monitoring entities was determined. It is noted that financial monitoring in Ukraine is carried out at two levels: primary and state. The importance of the primary financial monitoring entities functions are characterized. The changes in the legislation in the financial monitoring field, which were introduced in connection with the declaration of martial law, were identified. It is stated that the entities of the primary monitoring should continue to exercise the enhanced control over financial transactions in modern conditions. The article states that the rapid rate of growth of information arrays contributes to the «shading» of financial transactions and hinders the operational monitoring of activities that may be related to money laundering and terrorist financing. The enumeration of operational and strategic analysis criteria for financial monitoring of financial operations, which was expanded under martial law conditions, is given. The list of suspicious financial transactions proposed by FinCEN and the U.S. Department of Commerce’s Bureau of Industry and Security Urge was provided. The number of materials on violations of financial monitoring legislation and the amounts of suspicious transactions that were discovered during the period of martial law in Ukraine is indicated. The national method of financial monitoring is developed in accordance with the standards and recommendations of the Financial Action Task Force on Money Laundering. So, the principles of the risk-oriented approach, which is used in the detection of suspicious financial transactions that may finance terrorist activities, are considered.
